1. Acceptance of These Terms

These Terms of Use (the “Terms”) govern access to and use of the website operated by Sotra Link AS and any related pages, content, and services made available via this site (collectively, the “Site”). By accessing or using the Site, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Site.

You must be at least 16 years old to use the Site. If you are under 18, you may only use the Site under the supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Sotra Link AS shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages; loss of profits, revenue, data, goodwill, or business interruption; or costs of substitute services, arising out of or related to your use of the Site or our services, even if advised of the possibility of such damages.

In all cases, our aggregate liability for any claim relating to the Site or services shall not exceed the greater of: (a) the total amount you paid to Sotra Link AS for the service giving rise to the claim in the 12 months preceding the event; or (b) NOK 1,000. The limitations in this section apply to the fullest extent permitted by law and regardless of the legal theory asserted.

9. Indemnification

You agree to defend, indemnify, and hold harmless Sotra Link AS and its directors, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Site or services; (b) your violation of these Terms; or (c) your violation of any law or third-party right.

10. Force Majeure

We will not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including natural disasters, acts of government, labour disputes, power failures, internet failures, cyberattacks, civil disturbances, epidemics or pandemics, or failures of third-party hosting or cloud services.

11. International and Cross-Border Use

Sotra Link AS operates from Norway. We do not represent that the Site or services are appropriate or available in every jurisdiction. Accessing the Site from territories where the content or services are illegal is prohibited. If you access the Site from outside Norway, you do so on your own initiative and are responsible for compliance with local laws. We may restrict access to certain content in specific regions to comply with applicable requirements.

12. Governing Law and Jurisdiction

These Terms and any dispute or claim (contractual or non-contractual) arising out of or in connection with them, the Site, or our services shall be governed by and construed in accordance with the laws of Norway, without regard to conflict-of-law principles. The courts of Bergen, Norway, shall have exclusive jurisdiction for business users. If you are a consumer resident in the EEA, you may bring proceedings in your home country as required by mandatory consumer protection law. Nothing in these Terms limits your statutory rights.

13. Dispute Resolution

Before starting formal proceedings, each party agrees to attempt an informal resolution by giving written notice of the dispute and allowing 30 days for good-faith discussions. If the dispute is not resolved within 30 days, either party may proceed in accordance with Section 12. Class or collective actions are not permitted to the extent allowed by applicable law. Consumers retain any non-waivable rights under mandatory law.

14. Termination and Suspension

We may suspend or terminate your access to the Site at any time, with or without notice, if we reasonably believe you have violated these Terms, present a security or legal risk, or discontinue the Site. Upon termination, the rights and licenses granted to you will end immediately. Sections relating to intellectual property, disclaimers, limitations of liability, indemnification, governing law, and dispute resolution will survive termination.

15. Severability

If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Sotra Link AS regarding the Site and services and supersede all prior or contemporaneous understandings on the subject matter. Any additional or conflicting terms proposed by you are rejected and have no effect unless expressly agreed in writing by Sotra Link AS.

17. Assignment

You may not assign, transfer, or delegate any rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms to an affiliate or in connection with a merger, acquisition, reorganization, or sale of assets, provided that such successor is bound by terms substantially similar to these.

18. No Waiver

Our failure to enforce any right or provision under these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by Sotra Link AS to be effective.

19. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on the Site at least 14 days before they take effect, unless a shorter period is required to comply with law or address security, privacy, or operational issues. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

20. Electronic Communications and Signatures

You consent to receive communications from us electronically and agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing. Electronic signatures and records are valid and enforceable under applicable law, including eIDAS and relevant Norwegian legislation.
